Terms and Conditions

Welcome to ZAPPEE ("we", "our", "us"). These Terms and Conditions ("Terms") govern access to and use of our marketplace platform, which includes the ZAPPEE mobile applications and websites for Customers, Vendors, and Delivery Partners (collectively, the "Service"). By accessing or using any part of the Service you agree to be bound by these Terms.

If you do not agree, please do not use the Service.


1. Definitions

Term Meaning
Customer A user who browses or purchases products through the ZAPPEE Customer App.
Vendor A business or individual that lists fashion products for sale via the Vendor App.
Delivery Partner An independent contractor who collects orders from Vendors and delivers them to Customers via the Delivery Partner App.
Order A request by a Customer to purchase one or more Products from a Vendor.
Product Any item listed for sale by a Vendor on the Service.

2. Eligibility

  • The Service is intended for individuals aged 12 years or older. If you are under 18, you must use the Service only with the involvement and consent of a parent or legal guardian.

  • By using the Service, you represent that you meet these requirements and have the legal capacity to enter a binding contract.


3. Account Registration & Security

  1. Browsing Products is permitted without an account. Placing an Order or accessing Vendor/Delivery Partner functionalities requires creating an account.

  2. You agree to provide accurate, current, and complete information during sign‑up and to keep it updated.

  3. You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account.

  4. Notify us immediately at support@zappee.in of any unauthorized use or security breach.


4. User Roles & Conduct

Customers

  • Review product details carefully before ordering.

  • Pay applicable charges (product price, taxes, delivery fees) via Razorpay or Cash on Delivery ("COD").

Vendors

  • Ensure all listings are accurate and lawful.

  • Accept or reject Orders promptly (within the time communicated in the Vendor App).

  • Comply with all applicable laws, including those on product safety, labeling, and taxation.

Delivery Partners

  • Collect Orders from Vendors and deliver them to Customers in the condition received.

  • Verify any return requests initiated within 8 hours of delivery.

  • Comply with all traffic, safety, and commercial regulations.

All Users must not:

  • Violate any laws or third‑party rights.

  • Attempt to gain unauthorized access to the Service.

  • Disassemble, decompile, or reverse‑engineer any part of the Service.


5. Orders & Payments

  1. Prices are set by Vendors and may include applicable taxes.

  2. Commission: ZAPPEE charges Vendors a 10 % commission on each sale. Customers are not charged any platform fee.

  3. Payment Methods: We support Razorpay (UPI, cards, net‑banking, wallet) and COD. Additional methods may be added at our discretion.

  4. Payment processing is handled by third‑party providers; we are not liable for errors or delays caused by them.


6. Delivery

  1. Title and risk in the Product transfer from Vendor to Customer upon delivery.

  2. Estimated delivery times are provided for convenience and are not guaranteed.

  3. Liability: In cases of loss, damage, delay, or incorrect delivery, primary responsibility rests with the Vendor and/or Delivery Partner, as applicable. ZAPPEE may facilitate resolution but is not a party to the sale.


7. Cancellations, Returns & Refunds

Cancellation (before Vendor acceptance) Tap “Cancel” in order details Full refund (if prepaid) within 5–7 business days
Return (within 8 hours of delivery) Initiate return in app; hand the item to the Delivery Partner Delivery Partner inspects; if approved, refund processed automatically within 5–7 business days

Products must be unused, in original packaging, and with all tags intact for a return to be approved.


8. Intellectual Property

  • All content, trademarks, logos, and software on the Service are owned by ZAPPEE or its licensors.

  • You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent.


9. Privacy & Data

  1. We collect the following personal data:

    • Customers: Name, phone number, delivery location

    • Vendors: Name, store name, phone number, location

    • Delivery Partners: Name, phone number, location

  2. Data is shared among Customers, Vendors, and Delivery Partners solely for order fulfillment and communication.

10. Prohibited Activities

You agree not to:

  • Use the Service for unlawful purposes,

  • Transmit any viruses or harmful code,

  • Interfere with security features,

  • Harvest or scrape data without permission.


11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted or error‑free.


12. Limitation of Liability

To the fullest extent permitted by law, ZAPPEE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.


13. Indemnity

You agree to indemnify and hold harmless ZAPPEE, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or connected with:

  • Your breach of these Terms,

  • Your misuse of the Service,

  • Any claim by a third party relating to content you submit.


14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you are violating these Terms, abusing the Service, or engaging in fraudulent or illegal activities.


15. Changes to Terms

We may revise these Terms from time to time. Updated Terms will be posted in the app and on our website with a new "Last Updated" date. Continued use after such changes constitutes acceptance of the updated Terms.


16. Governing Law & Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict‑of‑law provisions.

  • Courts in Visakhapatnam, Andhra Pradesh shall have exclusive jurisdiction over any dispute arising out of these Terms or the Service.
